Israel’s Military Advocate General ordered the withdrawal of an indictment Thursday against five reservists from “Force 100” who had served at the Sde Teiman detention facility, citing exceptional circumstances that made continuing the prosecution incompatible with ensuring a fair trial. The case, opened in July 2024, investigated allegations that the soldiers had seriously assaulted a security detainee held at the facility. Their arrest and the public nature of the investigation triggered widespread controversy and protests, including incidents in which demonstrators attempted to break into military bases.
According to the Military Advocate General, the decision followed a comprehensive review of evidence and legal considerations surrounding the case. Officials cited several factors that complicated the prosecution, including challenges with the evidentiary foundation and unprecedented circumstances linked to actions by certain senior officials involved in the affair. Additional complications arose from difficulties obtaining some investigation materials from a related Israeli police inquiry, which prosecutors said affected the defendants’ legal rights. The situation was further complicated by the fact that the former detainee central to the allegations is currently located in Gaza, raising additional obstacles for the evidentiary process.
The Military Advocate General concluded that the combination of these unusual circumstances created a situation where continuing the indictment could compromise the basic rights of the defendants. The IDF Spokesperson’s Unit emphasized that enforcing the law and holding individuals accountable remains a core mission of the Military Advocate General’s Corps, and stressed that the body will continue to operate independently and professionally.
Israel’s Chief of the General Staff was briefed on the decision and instructed the military to draw lessons from the incident and implement steps to prevent similar situations in the future. He reaffirmed that the professional independence of the Military Advocate General’s Corps is a fundamental principle within the Israel Defense Forces and expressed support for the legal officials who continue to carry out their duties while the military operates during ongoing conflict.
